These terms govern your use of xpanion.com. They do not govern the Xpanion application: if you subscribe to Xpanion, your use of the software is governed by the Subscription & Software Terms, which you accept separately at checkout. Where the two documents differ, the Subscription & Software Terms prevail for anything concerning the software.

You may read this site, and quote from it with attribution. You may not scrape it at a rate that burdens the service, attempt to breach its security, or use it to distribute malware.

Descriptions of Xpanion on this site — features, tiers, system requirements, availability and pricing — describe intended functionality. They are not binding offers and they may change before release. Prices shown are the prices planned at the time of writing.

Where this site states a price to consumers in the European Union, that price is the total price including value added tax. Prices stated to business customers are exclusive of tax.

Xpanion documents that a disclosure was made. It does not certify that recording is lawful where you are. That judgment is always yours.

Rules on recording a conversation differ by country, by state, and by profession, and some require the consent of every participant. Establishing what applies to you, and obtaining any consent you need, is your responsibility. Nothing on this website is legal advice.

Xpanion's time ledger is append-only, hash-chained, and signed locally on your Mac. That makes it tamper-evident: an alteration is detectable. It is not "court-proof", and we make no representation about how any court, regulator, auditor or client will treat it. That judgment stays yours.

The Xpanion name and mark, the Valinorsk name and mark, and all content on this site are the property of Valinorsk LLC. No reproduction, distribution or derivative works without prior written consent.

Where this site links to third-party websites, we have no control over their content and accept no responsibility for it. A link does not imply endorsement.

This website and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the information is accurate, complete or current.

To the fullest extent permitted by law, Valinorsk LLC, its members, officers, employees and agents are not liable for indirect, incidental, special or consequential damages arising from your use of, or inability to use, this website.

Section 12 applies if you are a consumer in the European Union or the United Kingdom, and overrides sections 9 and 10 to the extent stated there.

We may update these terms. The date at the top of this page reflects the current version.

Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, for intent or gross negligence, for the breach of an obligation essential to the purpose of the contract, or for any other liability that cannot lawfully be limited or excluded.

These terms and your use of this site are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules, and the courts of Wyoming have jurisdiction.

If you are a consumer, this does not deprive you of the protection of the mandatory provisions of the law of the country in which you live, and you may bring proceedings in the courts of that country.
